Welcome to Wheelie! These Terms and Conditions ("Terms") govern your use of the Wheelie mobile application and related services (the "Service") provided by Wheelie ("we," "our," or "us"). By accessing or using the Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account or using the Service, you confirm that you are at least 13 years old and agree to comply with these Terms. If you do not agree with any part of these Terms, you must not use the Service.
2. Description of Service
Wheelie is a decision-making application that allows users to create customizable spinning wheels, share them with others, vote on options, and spin to make decisions. The Service includes features such as shared wheels, squads, voting, auto-pop scheduling, and push notifications.
3. User Accounts
- You are responsible for maintaining the confidentiality of your account credentials.
- You agree to provide accurate and complete information when creating your account.
- You are responsible for all activity that occurs under your account.
- You must notify us immediately of any unauthorized use of your account.
4. User Content
You retain ownership of any content you create within the Service (wheel names, options, descriptions, etc.). By creating content, you grant us a non-exclusive, worldwide license to use, display, and distribute your content solely for the purpose of operating and providing the Service.
You agree not to create content that is:
- Illegal, harmful, threatening, abusive, or hateful
- Infringing on others' intellectual property rights
- Spam, misleading, or fraudulent
- Containing malicious code or scripts
5. Shared Wheels and Collaboration
When you share a wheel with other users or join a squad, you consent to your profile information and activity on that wheel being visible to other participants. You are responsible for the content you add to shared wheels.
6. Intellectual Property
The Service, including its design, graphics, code, and branding, is owned by Wheelie and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service.
7. Prohibited Uses
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to the Service or its systems
- Interfere with or disrupt the Service or servers
- Scrape, mine, or harvest data from the Service
- Impersonate any person or entity
- Use automated tools to access the Service without our consent
8. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure. The results of any wheel spin are random and for entertainment purposes — we are not responsible for decisions made based on wheel outcomes.
9. Limitation of Liability
To the fullest extent permitted by law, Wheelie shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us (if any) in the twelve months preceding the claim.
10. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may delete your account at any time. Upon termination, your right to use the Service ceases immediately.
11. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes through the app or via email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction.
